TERMS FOR ARRANGING THIRD-PARTY OFFERS

The provisions in this section apply to all offers in which BALITOURGUIDE.DE acts as an intermediary for third-party offers.

1. General

Through this website, BALITOURGUIDE.DE arranges tours for customers/travellers with the person named below and his family, hereinafter also referred to as the contractor.

Contractor: I Ketut Suputra – Bali – Indonesia

The arrangement services are free of charge for the customer/traveller.

BALITOURGUIDE.DE pursues no commercial interests with its arrangement services.

The sole intention of BALITOURGUIDE.DE is to support the contractor in developing his tour programmes on Bali.

2. Scope of services

BALITOURGUIDE.DE expressly points out to all customers/travellers that arranging tours (carried out by the contractor) does NOT create travel contracts under conventional law.

Only an agency agreement is concluded with BALITOURGUIDE.DE.

The following conditions therefore apply exclusively to our arrangement activities and have no influence whatsoever on the conditions under which the arranged trips take place.

Within the scope of the services offered, it is expressly left to the respective participants/travellers to inform themselves about the conditions on the spot when deciding whether to accept a tour offer, insofar as these go beyond the information collected and communicated by BALITOURGUIDE.DE.

3. Conclusion of contract, applicable law

By making the down payment to BALITOURGUIDE.DE, the customer/traveller agrees to take part in the tour.

This expressly does not create an agency agreement.

BALITOURGUIDE.DE checks the availability of the requested service, makes a reservation with the contractor on behalf of the customer/traveller and forwards the booking.

4. Payment, liability

After confirmation by the contractor, the customer/traveller receives a written confirmation. With the booking confirmation, the customer/traveller is asked to make a down payment of 20% of the requested tour prices. This is only required as financial security for the contractor. The remaining payment of the tour prices is made on Bali, directly to the contractor.

Should the tour not take place due to illness or other occurrences and the lack of an alternative, BALITOURGUIDE.DE will refund the down payment in full to the customer/traveller who made it.

BALITOURGUIDE.DE is not liable for the proper performance of the booked and pre-paid tours and cannot be held liable in the event of an accident or damage during the tour. Appropriate insurance must be taken out independently by the customer/traveller in advance and is expressly recommended by BALITOURGUIDE.DE.

5. Changes to services and prices

Changes to or deviations of individual travel services from the agreed content of the arrangement are possible at any time and must be agreed with the contractor on the spot.

As a result of extreme increases in fuel prices on Bali, price changes are possible at any time after consultation between BALITOURGUIDE.DE and the contractor.

6. Cancellation by the customer/traveller

Every customer/traveller can cancel their booked tour free of charge up to 14 days before the start of the trip. The down payment will be refunded by bank transfer within 14 days.

In the event of cancellation after this point, the down payment cannot be refunded.

7. Services not used

If the customer/traveller does not use individual travel services due to early return or for other compelling reasons, the contractor is not obliged to refund the price of the trip.

8. Place of jurisdiction

Every arrangement made through BALITOURGUIDE.DE results in a contract directly between the customer/traveller and the contractor. For this reason, the contractor's place of jurisdiction, Bali/Indonesia, applies in the event of disputes.

Any claims for compensation of any kind must be made directly to the contractor.
